Terms and Conditions of Business

1. Definitions

"Company" means FocusedServices.

"Customer" means the person, company or organisation instructing the Company to provide Services.

"Services" means repairs, servicing, inspections, examinations, maintenance, breakdown attendance, supply of parts and any other work undertaken by the Company.

2. General

These Terms and Conditions apply to all work undertaken by the Company unless otherwise agreed in writing.

By instructing the Company to carry out work, the Customer accepts these Terms and Conditions.

No variation shall be valid unless agreed in writing by the Company.

3. Quotations

Quotations are valid for 30 days unless otherwise stated.

Quotations are based upon the information supplied by the Customer.

Additional faults discovered during repairs may result in additional charges. The Company will seek approval before carrying out additional chargeable work wherever reasonably practicable.

4. Estimates

Any estimate is provided as guidance only.

The final invoice may differ if additional labour, parts or repairs become necessary after inspection.

5. Labour Charges

Labour is charged at the Company's current hourly rate unless a fixed price has been agreed.

Time spent travelling to and from the Customer's premises may be chargeable.

A minimum call-out charge may apply.

Emergency, weekend and bank holiday work may attract additional charges.

6. Parts

Parts supplied remain the property of the Company until paid for in full.

The Company reserves the right to fit equivalent quality parts where original parts are unavailable.

Any special-order parts are non-returnable unless faulty.

Electrical and electronic components are non-returnable once installed unless proven defective.

8. Repairs

Repairs are carried out using reasonable skill and care.

The Company cannot guarantee that repairing one fault will not reveal or cause additional underlying faults in ageing machinery or vehicles.

Temporary repairs are provided solely to restore operation and should not be regarded as permanent repairs.

9. Servicing

Routine servicing is carried out in accordance with the agreed scope of work.

Unless specifically agreed, servicing does not include dismantling major components or investigating hidden defects.

10. LOLER and PUWER Examinations

LOLER and PUWER examinations are visual and functional examinations carried out in accordance with applicable legislation and recognised industry guidance.

A report will be issued identifying defects observed at the time of examination.

Passing an examination does not guarantee future safety, reliability or continued compliance after the examination date.

The Customer remains responsible for maintaining equipment in a safe condition.

11. Breakdown Attendance

Attendance at a breakdown does not guarantee that the equipment can be repaired on site.

Where additional workshop repairs are necessary, a separate quotation may be provided.

Equipment left with the Company must be collected promptly following notification that work has been completed.

Storage charges may apply after 14 days unless otherwise agreed.

Unless otherwise agreed:

Invoices are payable within 30 days of the invoice date.

The Company reserves the right to request payment upon completion of work.

Interest may be charged on overdue accounts at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

The Customer shall be responsible for reasonable costs incurred in recovering overdue debts.

16. Warranty

Repairs carried out by the Company are warranted for 90 days from the date of invoice against defects in workmanship.

Manufacturer warranties apply to supplied parts where applicable.

The Company's total liability shall not exceed the value of the invoice relating to the work carried out.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot lawfully be excluded.

18. Force Majeure

The Company shall not be liable for failure to perform its obligations due to events beyond its reasonable control, including severe weather, industrial action, supply shortages, fire, flood or acts of government.

19. Cancellation

Where work is cancelled after parts have been ordered, the Customer shall pay for all non-returnable parts and any labour already undertaken.

Cancelled appointments may be subject to a cancellation charge where less than 24 hours' notice is given.

20. Health and Safety

The Company complies with applicable health and safety legislation.

Engineers may stop work immediately if unsafe conditions exist.

21. Environmental Responsibilities

Waste oils, filters and hazardous materials removed during servicing shall be disposed of in accordance with applicable environmental legislation unless otherwise agreed.

22. Privacy

Customer information will be used solely for the administration of work carried out and will be processed in accordance with applicable data protection legislation.

23. Governing Law

These Terms and Conditions shall be governed by the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
